By accessing or using PureCut ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Service.

These Terms apply to all users of the Service, including visitors, registered users, and paying customers. By creating an account through any method (including email registration, Google OAuth, or other third-party authentication services) or using our Service, you represent that you are at least 18 years old or have parental consent and that you have read, understood, and agree to these Terms and our Privacy Policy.

PureCut provides AI-powered background removal services for digital images. Our Service allows you to:

• Upload images for background removal processing
• Download processed images with transparent backgrounds
• Access batch processing features (for paid plans)
• Manage your account and usage through our web interface

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice to users.

To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

You may terminate your account at any time through your account settings. We may terminate or suspend accounts that violate these Terms.

We offer various pricing plans with different credit allowances. Current pricing is available on our pricing page and may be updated from time to time with reasonable notice.

Payments are processed through secure third-party payment providers. By providing payment information, you authorize us to charge the applicable fees.

Refunds are handled on a case-by-case basis. Contact our support team within 7 days of processing if you're unsatisfied with results. Unused credits from cancelled subscriptions are not refundable.

Credits are consumed based on image size: 1 credit for images up to 12MP, 2 credits for 12-24MP, and 4 credits for larger images. Free plan balances are topped up to 5 credits each month; if you already have 5 or more, no additional credits are added.

Unused paid-plan credits remain in your balance. When a new billing cycle begins or you upgrade mid-cycle, we only add additional credits if your current balance is lower than the monthly allowance for your plan. Downgrading never removes previously earned credits, but future monthly top-ups follow the lower plan limits.

You may use our Service for legitimate personal, educational, and commercial purposes, including:

• E-commerce product photography
• Social media content creation
• Professional design work
• Educational and research purposes

You may not use our Service to:

• Process images that violate laws or regulations
• Upload copyrighted content without permission
• Create fake or misleading identification documents
• Process illegal, harmful, or offensive content
• Attempt to reverse engineer or copy our AI models
• Use automated tools to abuse the Service

You retain all rights to your original images and the processed results. By using our Service, you grant us a limited license to process your images solely for the purpose of providing background removal services.

The Service, including our AI models, software, and website, is protected by copyright and other intellectual property laws. You may not copy, modify, or create derivative works based on our Service.

Any feedback or suggestions you provide about our Service may be used by us without compensation or attribution.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using our Service, you also agree to our Privacy Policy.

Key privacy commitments:

• Processed images expire after 30 days
• We do not use your images for training our AI models
• All data is encrypted in transit and at rest
• We offer data residency options for enterprise users

While we strive for high availability, the Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free service.

We aim for high-quality results but cannot guarantee perfect background removal for all images. Results may vary based on image quality, complexity, and other factors.

Our total liability to you for any claims related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

Either party may terminate this agreement at any time. Upon termination:

• Your access to the Service will be suspended
• Any outstanding payments become immediately due
• Your data will be deleted according to our Privacy Policy
• These Terms will continue to apply to past use of the Service

We may update these Terms from time to time. When we make significant changes:

• We will update the "Last updated" date
• We will notify users by email or through the Service
• Changes become effective 30 days after notification
• Continued use constitutes acceptance of updated Terms

These Terms are governed by the laws of the jurisdiction where our company is incorporated. Any disputes will be resolved through binding arbitration, except for claims that may be brought in small claims court.

Before initiating any formal dispute resolution, parties agree to attempt good faith negotiations for at least 30 days.
